Terms of Service
Announced: October 18, 2026 · Effective: October 25, 2026 · Previous version: January 30, 2026
Article 1 (Purpose)
These Terms set out the conditions and procedures for using the website, the imSim solution portal (the "Portal") and other related services (the "Services") provided by immersivecast Co., Ltd. (the "Company"), and the rights, obligations and responsibilities of the Company and users.
This English text is a translation. If it differs from the Korean text, the Korean text prevails.
Article 2 (Definitions)
• "Portal" means the Company's website (imsim.app) that shows results of simulation tests and scoring of robots and AI on standard scenarios, and lets members commission tests or run them directly.
• "Member" means a person who has agreed to these Terms and the Privacy Policy and created a Portal account. A free member is a member who does not belong to an organization; a customer member belongs to an organization that has a contract with the Company.
• "Public results" means the test videos, verdicts, verdict evidence and verdict rules that the Company publishes on the Portal.
• "Sample" means example material that the Company publishes to show the format of a result file or of test recording data.
• "Attempt" means the unit of running one trial of a test in a direct run.
• "Result file" means the report, verdict evidence, trial videos and file list that the Company produces and delivers for a member's run or request.
Article 3 (Posting and Changes)
• The Company posts these Terms on the website and the Portal.
• The Company may change these Terms within the limits of the law, and announces the changes and their effective date 7 days in advance (30 days for changes unfavorable to members).
• A member who does not agree to the changed Terms may withdraw. Continued use of the Services after the effective date means agreement to the changed Terms.
Article 4 (Sign-up and Accounts)
• Sign-up is complete when the user agrees to these Terms, the Privacy Policy and the processing of account information abroad on the sign-up screen and confirms their email. A Google account can also be used.
• Customer members must enroll two-step verification (authenticator app) to see their organization's material.
• Members must keep their account information safe and may not lend or transfer their account to others.
• The Company may refuse or cancel a sign-up made with false information, by a child under 14, or by a person previously restricted for violating these Terms.
Article 5 (Services)
The Company provides the following Services.
• Viewing public results: open to everyone without sign-up
• Try it: reading a robot file instantly (the file is read only inside the user's browser and is not sent to the Company), viewing result file samples, viewing verdict rules
• Member functions: downloading the full report of the result file sample, downloading the test recording data sample, submitting test requests, inquiries
• Direct runs: members choose a test on the public results table, request a simulation run and receive the result
• Uploading your robot and connecting your AI: uploading a member's robot file for checks, or connecting a member's AI server to tests
• Custom validation: tests tailored to a member's robot, task and site conditions; scope, schedule and price are set in a separate contract
Direct runs, robot upload and My AI connection are opened first to members invited by the Company (pilot operation).
Article 6 (Free Use and Limits)
• Free members may use direct runs free of charge within a set number of attempts per month (currently 100). The limit is refilled on the 1st of each month (UTC), and unused attempts do not carry over.
• Failed runs do not use attempts. If a member stops a run, only the attempts actually run are counted.
• Depending on simulation capacity, the Company may set daily run volume, concurrent runs and queue order, and announces changes to limits and eligibility on the Portal.
• Free use is free of charge unless the Company states otherwise.
Article 7 (Uploaded Material)
• Rights to robot files, AI connection information and request material uploaded by a member remain with the member. The member warrants that they have the right to upload it.
• The Company uses uploaded material only for checks, test runs, producing result files and replying to inquiries, and does not disclose it or use it for other purposes without the member's consent.
• Robot files are deleted automatically 90 days after last use, with a notice on the Portal 7 days before deletion. Members may request deletion at any time.
• Files containing malicious code, material infringing others' rights, or material whose export is restricted by law may not be uploaded.
Article 8 (My AI Connection)
• The member is responsible for the operation, security and rights of their AI server and the AI models running on it. The Company sends test information (camera images, robot state, etc.) through the connection registered by the member and receives responses only while a test is running.
• The Company includes the record of requests and responses exchanged during the test (response times, failure records, etc.) in the result delivered to the member.
• The Company is not responsible for results caused by the member's AI server failing to respond or sending incorrect responses.
Article 9 (Rights to Results and Public Material)
• Members may freely use result files produced from their direct runs or requests. The Company does not publish those results without the member's consent.
• Rights to the Portal's public results, samples, videos, verdict rules, screens and platform belong to the Company.
• Public results and samples may be quoted with the source (immersivecast imSim) and measurement date. They must not be altered, excerpted in a way that changes their meaning, or presented as a certification or test certificate.
• Members may download, load, train on and modify the test recording data sample for evaluation, research and development. They may not redistribute or sell the data itself (original or modified), and must cite the source (immersivecast imSim) and the recording date when using it in presentations or papers.
• Bulk copying or automated collection of Portal material requires the Company's prior written consent.
Article 10 (Nature and Limits of Results)
• Verdicts on the Portal are scored in the Company's in-house simulation environment under verdict rules published by the Company; they are not a certification or test certificate from an accredited testing body.
• Simulation results do not guarantee the performance of real robots and may differ from results in real environments. Each result carries its verdict rule version and measurement date.
• Public results are baseline results measured with the Company's baseline controller, not a performance ranking of robot manufacturers.
Article 11 (Member Obligations)
Members must not:
• use another person's account or misuse another person's information
• access the Services without permission, bypass security measures, or interfere with operations
• occupy simulation capacity unfairly, for example by sending large numbers of run requests by automated means
• misrepresent results obtained from the Services
• violate the law or these Terms
Article 12 (Changes to and Suspension of the Services)
• The Company may change the content of the Services for operational or technical reasons and announces significant changes on the Portal in advance.
• The Company may suspend the Services temporarily for maintenance, replacement, failures, communication outages or force majeure, and announces it afterwards if advance notice was not possible.
• Functions in pilot operation may change in scope or end depending on the Company's circumstances.
Article 13 (Restrictions and Withdrawal)
• If a member violates these Terms, the Company may issue a warning, restrict functions, suspend use or terminate the account, and gives the reason.
• Members may withdraw at any time by emailing contact@immersivecast.com; the request is handled after identity verification.
• On withdrawal, member information and usage records are destroyed under the Privacy Policy, except information that the law requires to be kept for the required period.
Article 14 (Limitation of Liability)
• The Company is not liable when it cannot provide the Services because of force majeure such as natural disasters, war or failures of telecommunication carriers.
• The Company is not liable for disruptions caused by the member's fault.
• For Services provided free of charge, the Company is not liable unless the law specifically provides otherwise, except for damage caused by the Company's intent or gross negligence.
• Members are responsible for the outcome of purchasing, design or operating decisions they make based on Portal results.
Article 15 (Governing Law and Jurisdiction)
• These Terms are governed by the laws of the Republic of Korea.
• Disputes regarding the Services are resolved through good-faith consultation between the Company and the member; failing that, by the court with jurisdiction under the Civil Procedure Act of the Republic of Korea.
Supplementary Provisions
• These Terms take effect on October 25, 2026.
